Islamic Jurisprudence (Usul Al Fiqh): Naskh
"Naskh" literally means obliteration. Naskh has been defined as the suspension or replacement of one Shariah ruling by anothr. Naskh operates only in law, not in beliefs. Naskh operates only when, (i) two evidences are of equal strength, (ii) they are present in 2 separate texts, (iii) there is genuine conflict which can not be reconciled, and (iv) the two texts are of two timeframe (one is later to the other).
There are scholars who do not agree that there is abrogation in the Quran (Ref: Principles of Islamic Jurisprudence by Dr. Hashim Kamali, Chapter on Naskh). They say that in Ayat 2 : 106 and 16 : 106, reference of "Ayah" is not to abrogation within the Quran but abrogation of earlier scriptures by the Quran. They also say that the 'so-called' conflict in the Quran can all be reconciled. Muhammad Asad has also mentioned in his Tafsir that there is no Naskh in the Quran. Abdul Hamid Abu Suleman feels that it was wrong on the part of earlier Ulama to turn Naskh into a doctrine of permanent validity instead of understanding it as the circumstance of history. (Ref. Islamic Theory of International Relations, a IIIT's publication). Abu Suleman suggests that Naskh's application should be limited to clear cases only such as change of Qiblah.

Qiyas can not repeal a text of the Quran or the Sunnah. Abrogation may be explicit (sarih) or implicit (dimni). According to majority there are 4 types of Naskh : (i) Quran by Quran, (ii) Quran by Sunnah, (iii) Sunnah by Quran, (iv) Sunnah by Sunnah. There is also another classification : (i) Naskh al Hukm, (ii) Naskh al Qiraah, and (iii) Naskh al Hukm Wal Tilwah. Naskh al Hukm means that ruling has been abrogated but the text remains. Naskh al Qiraah means that the text has been abolished but the ruling remains. In Naskh al Hukm wal Tilwah, both the text and rulings are treated as abrogated. Of the above three, Nakh al Hukm has some basis but the other two have very weak basis. Sayyid Abul Ala Maududi has explained in his "Rasail wa Masail” (Letters and Issues), why Naskh al Qiraah is not acceptable?
There is difference between Naskh (abrogation) and Takhsis (specification or qualification of a general text). There is no real conflict in Takhsis. Another issue is whether addition (Tazid) amounts to abrogation. The majority answer is negative, which is correct....

THE ETHICS OF WARFARE IN ISLAM
Allah enjoins justice and doing good to mankind ...
(Al-Qur'an, Surah An-Nahl, verse 90).
[1] Islam made warfare humane and it was undertaken only in vindication of the justice of Allah . It was never rapacious, revengeful and cruel. Muhammad – the Messenger of Allah - himself instructed, trained and
disciplined the army of Allah. It was a humane army but it was invincible, fired with new enthusiasm, imbued with the will to conquer and emboldened by the utter contempt of death inculcated by the Noble
Qur'an.
[2] `Do not use frauds nd deceptions', said the Messenger of Allah to his soldiers. `Do not kill children, do not oppress the peaceful inhabitants of the country conquered. Spare weak women. Have pity on suckling infants and the sick. Do not destroy houses, do not overrun the fields, do not devastate the orchards. Do not cut down date
palms. If u conclude a treaty, keep it. In Christian ountries, do not destroy ther churches nd monasteries'.
[3] Wit such an enlightened, well disciplined and well-trimmed army of Allah(s.w.t) Muhammad laid the foundation of the World Order of Islaam for the world humanity towards `Tawhid', that is, under the sole and universal sovereignty of Allah(s.w.t) one fraternity of mankind, one world kingdom
of Allah(s.w.t)..
Evn undr the worst connditions..one still muyst Fear Allah(s.w.t) All Times..evn then..hard as it can be nd will be.ur angre nd mind nd heart nd all thes emotions running ovr u durn' that time in battlefield.one must remebr Him evn during a wartime wher enemies ar coming at u..we ar still not to transgress.. wen one sites that the enemy has reasn or change of heart.(But how many times hav that evr happnd in history.VER RARE to NONE..but then one must hav change of heart.IF THEY CEASE..SO MUST U...but if not..u ar to continu to defend oneself ur famil nd land..one will not be punished for defending the ones u luv nd ur home...so ther wuld be no consequences upon us for any of that..as it is writtn...

Misconceptns about Wife Beating in Islaam
How does anyone of u beat his wife as he beats the stallion camel nd then embrace (sleep with) her?”...Think Common Sense now Peoples.. Considering the rates of domestic violence all ovr the world, this question, which was asked by the Prophet Muhammad more than 1400 years ago.. is applicable today to all people of all faiths nd cultures....
Despite the universality of domestic violence, Muslim men involved in wife-abuse have attracted more attention than others. Horrific stories of husbands beating ther wives while claiming that the Qur’an gives them the right to do so are highlighted in the media... At the same time, Muslims assert that Islam honors nd respects women, giving them rights that promote nd preserve their human dignity.
The crux of the matter lies in the need for the distinction between Islam and the behavior of some Muslims. Each and every Muslim has rather unfairly been caste as a representative of his or her faith, nd his or her behavior is immediately a reflection of Islam, not of the Muslim as a human individual.
This special file aims at clarifying the position Islam takes regarding wife-beating. Altho the material presentd, which is compiled frm various readng material dn studies concentrates on the very specific issue of wife-beating, it is essential to point out that Islam has extensively elaborated on the rights of women at all times nd in totality nd equality..

"According to the Qur'an the relationship between the husband and wife should be based on mutual love and kindness. Allah says: "And among His Signs is this, that He created for you mates from among yourselves, that ye may dwell in tranquility with them, and He has put love and mercy between your (hearts): verily in that are Signs for those who reflect." (Ar-Rum: 21)
The Qur'an urges husbands to treat their wives with kindness. [In the event of a family dispute, the Qur'an exhorts the husband to treat his wife kindly and not to overlook her positive aspects]. Allah Almighty says: “Live with them on a footing of kindness and equity. If ye take a dislike to them it may be that ye dislike a thing, and Allah brings about through it a great deal of good.” (An-Nisa’: 19)
It is important that a wife recognizes the authority of her husband in the house. He is the head of the household, nd she is supposed to listen to him. But the husband shuld also use his authority wit respect nd kindness towards his wife... If ther arises any disagreement or dispute among them, then it shuld be resolved in a peaceful manner... Spouses shuld seek the counsel of ther elders nd othr respectable family membrs nd friends to batch up the rift nd solve the differences...
Howevr, in some cases a husband may use some ""light disciplinary action"" in ordr to correct the moral infraction of his wife.. BUT this is Only Applicable in EXTREME CASES nd it shuld be resorted to if one is sure it wuld improve the situatin. Howevr, if ther is a fear that it might worsen ..the relationship or may wreak havoc on him or the family, then HE shuld AVOID it Completely.
The Qur'an is Very Clear on this issue... Almighty Allah says: "Men are the protectors nd maintainers of women, because Allah(s.w.t) has given the one more strength than the othr,nd because they support them from ther means. Therefore the righteous women are devoutly obedient nd guard in the husband's absence what Allah wuld have them to guard... As to those women on whos part u fear disloyalty nd ill-conduct, admonish them (first), (next), refuse to share their beds, (and last) beat them (lightly) but if they return to obedience, seek not against them means (of annoyance); for Allah is most High nd Great (above u all)... If u fear a breach between them twain, appoint (TWO) arbiters, one frm his family nd the othr frm hers... If they wish for peace, Allah will cause their reconciliation; for Allah has full knowledge nd is acquainted with all things." (An-Nisa': 34-35)
It is important to READ the section Fully. One shuld not take part of the verse nd use it to justify one's own misconduct. This verse neithr permits violence nor condones it... It guides us to ways to handle delicate family situation wit care nd wisdom. The word "beating" is used in the verse, but it does not mean "physical abuse". The Prophet (s.a.w)) explained it """Dharban Ghayra Mubarrih""" which means "a light tap that leaves no mark". He furthr said that face must be avoided. Some othr scholars are of the view that it is no more than a light touch by siwak, or toothbrush... like a lite touch..that wat it all means if anyone wantd to fully learn of this..
Generally, the Prophet (s.a.w) used to discourage his followers from taking even this measure... He nevr hit any female...nd he used to say ""That the Best of Men are those who DO NOT hit their wives""... In one hadith he expressed his extreme repulsion frm this behavior nd said, "How does anyone of you beat his wife as he beats the stallion camel and then embrace (sleep with) her?” (Al-Bukhari, English Translation, vol. 8, Hadith 68, pp. 42-43)
It is also important to note that even this "light strike" mentioned in the verse is not to be used to correct some minor problm... but it is permissible to resort to only in a situation of som serious Moral Misconduct wen admonishing the wife fails, nd avoiding from sleeping wit her wuld not help. If this disciplinary action can correct a situation nd save the marriage, then one should use it in the way of THE SUNNAH

Kuffaar nd Kaafir
Islaam teaches us to foster good relations with All Peoples....
Allah(s.w.t) says in the Qur’an..Serve Allah nd join not any partners wit Him nd do good to parents, kinsfolk, orphans, thos in need, neighburs who are near neighbors who are strangers.. the companion by your side, the way-farer nd thos undr ur authority.. indeed Allah(s.w.t) loves not the arrogant, the vainglorious (An-Nisa’ 4: 36)....
Maintaining ties wit family members, relatives, neighburs, communities nd societies... is emphasized a great deal in Islamic teachings. It is indeed difficult to maintain nd strengthen these ties if we busy ourselves labeling othrs... Somehow ingrained in the human psyche is the belief that one human being is possibly bettr than anothr... After all.. the countless wars thrughout history.. bear testimony to this absurd notion... Of course wars take place for a number of reasns, but the desire of a nation to destroy anothr is to assert one’s ‘Superior’ standing... The assumption that one is supposedly bettr than anothr also affects individuals... We are not always conscious of our thots.. but it does happn that sometimes we think of ourselves as being a bettr Muslim than anothr person... or wen we see certain actions acceptable to non-Muslims, we think that we are better than them. But this way of thinking can be dangerous, as it may result in one assuming a higher position of piety... ""In Fact"".. it is only Allah(s.w.t) who knows who is sincere in piety.. who is considered a Muslim in His sight....
Tawheed
Islam was established wit the creation of the first man.. Prophet Adam (peace be upon him)... His main task, nd the task of the all of the Prophets nd Messengers that followed.. was to firmly instill in the minds nd the hearts of the people the concept of Tawheed.. that Allah(s.w.t) the Almighty is one nd only one..nd that He alone has power ovr All Things nd He only deserves to be worshipped. Wen we talk about worshipping Allah(s.w.t) alone.. there seems to be much misunderstanding. Worship is not only about the rituals of Salaah, Fasting, Zakaah nd Hajj. Worshipping Allah(s.w.t) is holistic nd inclusive, meaning that evry aspect of our lives nd our actions are to please Allah(s.w.t). U cannot for instance perform ur salaah regularly, but then oppress ur servant or ur employee..u cannot be paying zakaah, nd then defraud people in ur business dealings... Simply announcing our belief is Not Nor Evr Will be sufficient enuff... we hav to liv the spirit of Islaam as well...
[Say (O Muhammad) my prayer, my sacrifice, my life nd my death belong to Allah(s.w.t) He has no partner nd I am ordered to be among those who submit (Muslims). (An’am 6:162-163)
That Allah(s.w.t) is the only power did not go down well wit many rulers, as we kno from the stories of Nimrod and Pharoah among many othrs... Nimrod had the audacity to say that he gives life nd death,AstaghFirAllah.. nd Pharoah’s arrogance led to his drowning.. nd we hav been informd in the Qur’an that for him is the most severe punishment...
So We seized him ad his hosts, nd We flung them into the sea.. now behold wat was the End of thos who did wrong! Nd we made them (but) leaders inviting to the Fire.. nd on the Day of Judgment no help shall they find. (Al Qasas 28: 40-41)...
Every Prophet conveyed the message of tawheed to his people, and warned that the denial of the oneness of Allah would lead to dire consequences. Some heeded the call and others did not. Islam teaches us that for all our actions, good and bad, there are consequences. We may meet those consequences in this life or in the hereafter. This is something that a Muslim must contemplate seriously. How conscious are we really of our daily actions? How sure are we that even though we are Muslim our actions could actually constitute kufr? No one should ever feel self righteous. No one has a one way ticket to Paradise.
Naturally Allah knew who He was going to appoint as Prophets and Messengers. We also know that they were mere human beings like us. All the Prophets endured trials and tribulations, more so after Prophethood was revealed to them. But we also know from the Qur’an that the Prophets often contemplated about life and about Allah. We know that Prophet Ibrahim (peace be upon him) wondered if the stars or the moon or the sun were his Lord. It is a natural instinct in mankind to seek to know the creator, so we all have an inbuilt sense of tawheed.
Our beloved Prophet Muhammad (peace be upon him) often retreated to the cave of Hira to contemplate, until the first revelation came to him.
In His infinite wisdom, Allah knew that he had already chosen these people to convey His message. He did not hold it against them when they contemplated and felt unsure. His mercy was still bestowed on them.
From the life of Caliph ‘Umar (may Allah be pleased with him) we know that before he accepted Islam he used to create idols from dates, and thereafter eat them. We know that he hated Muslims and hit his sister when he found out that she had accepted Islam. Yet Allah in his infinite wisdom knew that eventually ‘Umar would change his ways and enter into Islam. When he accepted Islam he was known to be a strong and kind Muslim and a just ruler.
Kufr
It is difficult for Muslims to believe that a Muslim can actually indulge in kufr. How is this possible? One may wonder. According to Imam Nawawi kufr “occurs sometimes by a statement which constitutes kufr and sometimes by an act. nd the actions which necessitate kufr (that expel from the religion) are thos which are performed deliberately (The Book of Apostasy). Some of the acts that culd render a Muslim a disbeliever are (and these are conditioned on the person being aware of the reality of their action)...
1. To call on saints or Prophets for help or to act as intercessors.
[And invoke not besides Allâh, any that will neither profit u, nor hurt u, but if (in case) u did so,u shall certainly be one of the Zâlimûn (polytheists and wrong-doers)] [10:106]
Referring to any authority other than Islam for judgment or being dissatisfied wit the decision of Islam.
[But no, by your Lord, they can hav no Faith, until they make you (O Muhammad SAW) judge in all disputes between them, nd find in themselves no resistance against ur decisions, nd accept (them) with full submission.] [4:65]
Slaughtering in the name of a Prophet or a pious man (saint).
[Therefore turn in prayer to your Lord and sacrifice (to Him only).] [108:2]
Circumambulation of graves as an act of worship. It is to be performed for Allah alone in the Holy Ka'bah.
[Then let them complete the prescribed duties (Manâsik of Hajj) for them, and perform their vows, and circumambulate the Ancient House (the Ka'bah at Makkah).] [22:29]
Depending on or putting trust in other than Allah. How many of us do this at times?
[And Mûsa (Moses) said: "O my people! If u have believed in Allâh, then put ur trust in Him if u are Muslims (those who submit to Allâh's Will).] [10:84]
These are just some acts that culd turn a Muslim into a Disbeliever... However, not everyone who commits an act of kufr is considered a kafir, nd these are the excuses...
1. Someone lives in a place where there is no scholar who can establish the evidence, remove misconceptions nd offer guidance.
2. Someone who is a new Muslim. That person is excused until he knows about the issues involved.
3. If there are misconceptions related to the situation, that person is excused until these are removed.
4. The un-agreed upon acts of which there are many.
Kufr and declaring someone a kafir are serious issues nd are not to be uttered lightly.... As individuals let us focus on strengthening our acts of faith nd drawing nearer to Allah(s.w.t) as Prophet Muhammad (s.a.w)) taught us. nd remembr if a person claims someone to be a kaffir nd it turns out to be untrue, thos words fall back on the one who said them at first. Definitely something to think about....
Allah(s.w.t) says in the Qur’an..Serve Allah nd join not any partners wit Him nd do good to parents, kinsfolk, orphans, thos in need, neighburs who are near neighbors who are strangers.. the companion by your side, the way-farer nd thos undr ur authority.. indeed Allah(s.w.t) loves not the arrogant, the vainglorious (An-Nisa’ 4: 36)....
Maintaining ties wit family members, relatives, neighburs, communities nd societies... is emphasized a great deal in Islamic teachings. It is indeed difficult to maintain nd strengthen these ties if we busy ourselves labeling othrs... Somehow ingrained in the human psyche is the belief that one human being is possibly bettr than anothr... After all.. the countless wars thrughout history.. bear testimony to this absurd notion... Of course wars take place for a number of reasns, but the desire of a nation to destroy anothr is to assert one’s ‘Superior’ standing... The assumption that one is supposedly bettr than anothr also affects individuals... We are not always conscious of our thots.. but it does happn that sometimes we think of ourselves as being a bettr Muslim than anothr person... or wen we see certain actions acceptable to non-Muslims, we think that we are better than them. But this way of thinking can be dangerous, as it may result in one assuming a higher position of piety... ""In Fact"".. it is only Allah(s.w.t) who knows who is sincere in piety.. who is considered a Muslim in His sight....
Tawheed
Islam was established wit the creation of the first man.. Prophet Adam (peace be upon him)... His main task, nd the task of the all of the Prophets nd Messengers that followed.. was to firmly instill in the minds nd the hearts of the people the concept of Tawheed.. that Allah(s.w.t) the Almighty is one nd only one..nd that He alone has power ovr All Things nd He only deserves to be worshipped. Wen we talk about worshipping Allah(s.w.t) alone.. there seems to be much misunderstanding. Worship is not only about the rituals of Salaah, Fasting, Zakaah nd Hajj. Worshipping Allah(s.w.t) is holistic nd inclusive, meaning that evry aspect of our lives nd our actions are to please Allah(s.w.t). U cannot for instance perform ur salaah regularly, but then oppress ur servant or ur employee..u cannot be paying zakaah, nd then defraud people in ur business dealings... Simply announcing our belief is Not Nor Evr Will be sufficient enuff... we hav to liv the spirit of Islaam as well...
[Say (O Muhammad) my prayer, my sacrifice, my life nd my death belong to Allah(s.w.t) He has no partner nd I am ordered to be among those who submit (Muslims). (An’am 6:162-163)
That Allah(s.w.t) is the only power did not go down well wit many rulers, as we kno from the stories of Nimrod and Pharoah among many othrs... Nimrod had the audacity to say that he gives life nd death,AstaghFirAllah.. nd Pharoah’s arrogance led to his drowning.. nd we hav been informd in the Qur’an that for him is the most severe punishment...
So We seized him ad his hosts, nd We flung them into the sea.. now behold wat was the End of thos who did wrong! Nd we made them (but) leaders inviting to the Fire.. nd on the Day of Judgment no help shall they find. (Al Qasas 28: 40-41)...
Every Prophet conveyed the message of tawheed to his people, and warned that the denial of the oneness of Allah would lead to dire consequences. Some heeded the call and others did not. Islam teaches us that for all our actions, good and bad, there are consequences. We may meet those consequences in this life or in the hereafter. This is something that a Muslim must contemplate seriously. How conscious are we really of our daily actions? How sure are we that even though we are Muslim our actions could actually constitute kufr? No one should ever feel self righteous. No one has a one way ticket to Paradise.
Naturally Allah knew who He was going to appoint as Prophets and Messengers. We also know that they were mere human beings like us. All the Prophets endured trials and tribulations, more so after Prophethood was revealed to them. But we also know from the Qur’an that the Prophets often contemplated about life and about Allah. We know that Prophet Ibrahim (peace be upon him) wondered if the stars or the moon or the sun were his Lord. It is a natural instinct in mankind to seek to know the creator, so we all have an inbuilt sense of tawheed.
Our beloved Prophet Muhammad (peace be upon him) often retreated to the cave of Hira to contemplate, until the first revelation came to him.
In His infinite wisdom, Allah knew that he had already chosen these people to convey His message. He did not hold it against them when they contemplated and felt unsure. His mercy was still bestowed on them.
From the life of Caliph ‘Umar (may Allah be pleased with him) we know that before he accepted Islam he used to create idols from dates, and thereafter eat them. All Praise belongs to Allah(s.w.t). We praise Him, we seek His help, nd we ask His forgiveness. We seek refuge in Allah(s.w.t) from the evils of our selves nd our bad actions. Whomevr Allah(s.w.t) guides...none can lead astray, nd whomevr He leads astray has no one to guide him.....
U KNOW YOUR ISLAM IS IN TRUBLE WEN…
the last thing u learnt about Islaam, the Quran, or Jihaad was from CNN/BBC ..
all your conversations wit ur friends hav to do with guys/girls, or movies, or guys/girls in movies
u spend more nights at the club during Ramadhan than at a Masjid....
u can't remembre the last time u asked someone a question about something u didn't understand in Islaam...
u find time to watch three movies a week ...but find urself too busy to pray Salah regularly...
that Qur'aan translation u were given last 'Eid ..is still sitting on the top shelf of your bookrack....
the 'inner voice' u hear wen u are in complete silence... sounds surprisingly similar to the latest hip-hop song u heard..
u don't know any people who u can say Salaams to without feeling embarrassed..
the feeling that God is watching u in all that u do... is never more than a passing thought..
u are available to receive phone calls at 2 a.m...
ur clothes nd hair smell of cigarettes on Sunday mornings evn thou u don't smoke...
knowing something is right or wrong nd feeling guilty about it does not effect whether u actually do it or not...
u gave hope of evr entering Paradise.. because u don't feel u deserve it after 'all that I have done'...
when u want something in ur life u fantasize about it nd say ...I wish! ...
u can't figure out why u are nevr truly happy deep in ur heart nd why nothing good in ur life evr seems to last (why does it always have to end?)..
the happiest day of ur life so far was on a Christmas, Valentine, or a dance...
u are loneliest wen u are sad or wen something bad has happened to u (where did all my friends go?)...
u don't think of the Prophet(s.a.w) at least once a day...
when u hear of Muslims dying somewhere in the world, u consider it part of 'politics' which u have nothing to do wit..
ur 'best friend' is a person of the opposite gender yet not your husband or wife...
u have no motivation to change things in ur life....
when ur faults are pointed out to u, u reply...This is who I am, for better or for worse..
listening to the Quran does not make you feel guilty
u are actually flattered wen people on the street stare or ask you out..
u friends nevr object to any of ur bad habits or behaviours nd vice versa...
u don't care whethr u go to heaven or hell... since no one can really be sure about these things..
to U... Islaam is just anothr 'organized institutionalized religion'...
u actually agreed everything ur philosophy professor taught in class..
ur consider nd justify ur sins as 'a part of who I am'
u want to travel around the world someday.. but Makkah is not one of your planned stops...
ur parents hate u and have said so to you..

Take Example in this Life whil Here..
Things U need to know about life, Learn from Noah's Ark...
One: Don't miss the boat. Two: Remembr that we are all in the same boat... Three: Plan ahead. It wasn't raining when Noah built the Ark. Four: Stay fit. Wen you're 600 years old, someone may ask u to do something really big. Five: Don't listen to critics.. just get on wit the job that needs to be done.... Six: Build ur future on high ground... Seven: For safety's sake, travel in pairs. Eight: Speed isn't always an advantage. The snails were on board with the cheetahs. Nine: Wen you're stressed, float a while... Ten: Remembr, the Ark was built by amateurs.. the titanic by professionals... Eleven: No mattr the storm, wen u ar wit God.. there's always a rainbow waiting.

Why is it ... ? 1)That a nun can be covered from head to toe and she's respected for devoting herself to God but when a Muslim woman does that, she's considered "oppressed"?
2)That a Jew can grow a beard and he's just practicing his faith, nd when a Muslim does that, he's an extremist?
3) Wen a Western woman stays at home to look aftr the house nd kids... she's sacrificing herself and doing good for the household, but when a Muslim woman does so, she "needs to be liberated"?
4) That when a child dedicates himself to a subject, he has potential, and when a child dedicates himself to Islam, he is hopeless?
5)When a Christian/Jew kills someone, RELIGION IS NEVER MENTIOND, (i.e., Ireland, Ruwanda nd the IRA or elswhere) ...but wen a Muslim is charged with a crime, it's Islam that goes to trial?
